Community Associations
Callahan and Fusco, LLC. represents Community Associations throughout New Jersey, New York, Pennsylvania and Florida. Our Community Association Group has experience in representing Condominium Associations, Homeowners Associations and Cooperatives in a general counsel capacity as well as matters relating to construction defects and debt collection.
Setting us apart from most other firms, each attorney in the Community Association Group is also a member of our Civil Litigation Group, ensuring that when you receive legal counseling to either avoid a lawsuit or institute one, it is coming from an experienced litigator that has represented Community Associations in Court before and understands the process completely.
Further, we understand every Community Association is different and requires specific and custom-tailored representation best fitted to serve the interests of that community. The following are just some of the services our Community Association Group offers:
Guiding Associations through the transition process, including engaging in mediation and litigation where necessary with Developers.
Interpretation and Counsel to Associations on the applicability of State and Federal Laws.
These include, but are not limited to, Fair Housing Act, American Disabilities Act, Housing for Older Persons Act and the Telecommunications Act of 1996.
State regulations for Community Associations and Non-Profit Corporations.
Interpretation and Drafting Master Deeds, Declaration of Covenants Easements and Restrictions, Bylaws, Amendments, Resolutions and/or Rules and Regulations
The collection of delinquent accounts including, but not limited to, the following:
Instituting legal action to obtain and collect money judgments.
Preparing and filing liens to secure a delinquent balance.
Obtaining rent receiverships.
Foreclosure.
Drafting and reviewing contracts on behalf of the Association between Management, Contractors and/or Employees.
Preparing and negotiating agreements between Community Associations and Municipalities, including easements and municipal reimbursements.
Attending Board and Membership meetings to ensure proper parliamentary procedure is followed as well as providing legal counsel as needed by the Association.
Assisting in Alternative Dispute Resolution (ADR) between the Membership and/or the Association.
Contact us and we will be glad to schedule a meeting so that we can discuss your community’s needs and implement a legal strategy to ensure it receives proper representation without stretching your Association’s budget thin.
